Egyptian Law - What you need to know and more

Egyptian Property law shouldn't be daunting. The Egyptian property law and legal system was implemented by the British during the many years that the Britain administered Egypt as part of the British Empire.

So it should come as a pleasant surprise that Egyptian property law is based on UK property law.

In essence, buying Freehold in Egypt is the same as when you buy Freehold in the UK , you own the property 100%. This applies to any property that you buy on mainland Egypt and the Red Sea Coast, unless the property for sale has some clauses specific to that particular purchase, other wise it is 100% Freehold.

On the Sinai Peninsula, which includes Sharm El Sheikh, you can only purchase Leasehold.

Elsewhere, expect 100% Freehold to be the norm.

 Areas for consideration when buying in Egypt, as you'd expect if you bought anywhere :-

  • If you are buying 'off plan' the builder must own the land that the building is  being built on and there are no legal disputes in the courts over the  ownership of the land.

Only purchase from a building company where you can see previously built properties.


  • Never purchase 'off plan' from a company who has never built in Egypt   before. It is advisable when transferring payments that monies are sent bank to bank to the actual building company/group in Egypt, never through an intermediary company whether they are termed 'marketing' or 'developers' in your own country. That way you are certain that your payments are received by the actual building company that is responsible for your chosen project .

  • Do the Egyptian builders complete their projects? And have they a track record of finishing on time?
